Lighting – Permanent lighting

Article 5, Section 5.11- Lights and Street Lights.  

Exterior low-voltages landscape lighting is encouraged, but as with any such improvement prior written approval for exterior lighting must be secured from the Committee.

Rules & Regulations – Holiday Decorations and lighting.  

Holiday decorations and lights shall be of reasonable design and magnitude so as not to disrupt neighboring dwelling Units and property and shall not be installed or utilized prior to 30 days before a holiday and shall be removed no later than 14 days following the same holiday.

Outdoor lighting:

Building and lot lighting

Any outdoor lighting installed on a lot or dwelling unit must receive prior written approval from the ACC. Permanent lighting sources shall not be directed towards streets, Common areas or neighboring property. Lighting mounted on the front or side of a building shall be in decorative fixtures that diffuse light and shall not contain colored bulbs. Pictures/brochures of proposed outdoor light and build wattage will be required at time of submittal tote ACC.

Landscape lighting

Owners may use low voltage lighting the highlight entry walks or accentuate trees where permitted by all applicable laws and ordinances and these Design Guidelines. Colored bulbs and lenses are prohibited. Light source shall be adjusted to minimize glare on adjacent properties, Common Areas and streets.

 

Garage - interiors/renovations

Article 5, Section 5.5 – Use of Garages.  

NO garage can be converted to living spaces without prior written consent from the Committee.

Rules & Regulations – Garages

Pursuant to Section 5.5 of the Declaration Garages, including garage doors, are to be always maintained in a neat and clean condition. Garages are to be used for the parking of vehicles and the storage of normal household items, supplies, and materials.  Owners and residents shall first park vehicles inside and fully utilize the garages for parking vehicles before utilizing the driveway and shall fully utilize the garage and driveway before utilizing the Roadways for parking. The storage of items in garages may not restrict the ability to park at least one vehicle per stall within the garage. Garages are not permitted to be converted into living quarters without written approval from the ACC. Garage doors are only to be left open for ingress and egress.

 

Section 5.5 Uses of Garages: No garage may be converted to Living space without the prior written consent of the Committee except that declarant or Homebuilder (with the consent of Declarant) may use a garage area in a model home or models for sales office. Owners shall keep gtarages neat, clean and free from clutter, debris or unsightly objects and at all times keep garages neat, clean and free from clutter, debris or unsightly objects and shall at all times keep garage door closed except as reasonably necessary for ingress and egress. Owners and residents shall first park vehicles inside and fully utilize the garage before utilizing the driveway and shallfully utilize the garage and driveway before utilizing the Roadways for Parking.

Note: you are required to also obtain permits from the Town of Gilbert.

Page 10: Except as provided below, vehicle parking is permitted only in the garage or on the a driveway or an approved driveway extension. Vehicles, including those of guest of the Owner or Resident must first utilize the garage for parking, then the driveway or approved concrete or paver driveway extension before parking in the street. Vehicles may not be parked on any portion of the front yard that is not the driveway or part of a paved driveway extension. Vehicles are not to be parked in a manner that blocks or obstructs the sidewalk.

No commercial vehicles or Recreational vehicles (as defined in section 5.10 of the Declaration shall be parked in front of a lot on the street on in the front driveway or otherwise where it can be seen from any street except for temporary parking only not exceeding 4 consecutive hours. Commercial vehicles shall not include sedans or standard size pick up trucks used for business and personal use, provided that any signs or markings of commercial nature on such vehicles shall be unobtrusive and inoffensive as determined by the ACC.

 

Street Parking - overnight street parking (no timeframe is given for overnight parking).

Owners shall keep their garages neat, clean, and free from clutter, debris or unsightly objects and shall at all times keep garage doors closed except as reasonably necessary for ingress and egress. Owners and residents shall first park vehicles inside the and fully utilize the garage before utilizing the driveway and shall fully utilize the garage and driveway before utilizing the Roadways, for parking.

Vehicles, including those of guests of the owners or resident. Must first utilize the garage for parking, then the driveway or approved concrete or paver driveway extension before parking in the street.

 

Weeds – keep up with the removal

Article 5, Section 5.22 – Landscaping: Lot improvements: Weed Control: Landscaping. 

All landscaping, at all times, must be maintained by each Owner in a neat and attractive manner and any alterations or modifications made to the original landscaping of a Lot as originally installed shall be approved in advance by the Committee. To include, (ii) maintain the landscaping in a neat and attractive manner, (iii) maintain all Lot improvements, (iv) keep the Lot free from weeds.

Rules & Regulations – Landscape Maintenance.  

All landscaping shall be maintained in a neat and attractive condition. Minimum maintenance requirements include watering, mowing, edging, pruning, removal and replacement of dead or dying plants, removal of weeds and noxious grasses, removal 0f tree suckers and volunteer trees/plants, removal of trash, leaves and debris.  

 

Tree Replacement’s – requirement for front yard trees.

Article 5, Section 5.22 – Landscaping: Lot improvements: Weed Control: Landscaping.

A “Street Tree” program shall be implemented through this Declaration and the Design Guidelines, whereby each residential street shall have a designated “Street Tree” and that the Owner with respect to their Lot, if not installed by the Declarant, shall install at least one Street Tree in the front yard of each Lot consistent with the designated Street Tree species.

Rules & Regulations – Plant Requirements.

Approved and Prohibited plants are listed on Appendix “A” and “B” respectively located at the end of the Rules & Regulations. Owners are to select low shrubs/plants/ground covering along driveway and street frontages to maintain visibility. Plant material is not permitted to attach itself to any wall and/or metal view fence,

At least one (1) Street Tree shall be installed from a 24 “box and no less than three (3) feet from any wall. Street Trees - Please refer to the Street tree Master Plan for your Street Tree located on the owner portal under “All documents” then “Maps.”

 

Garbage and Trash

Article 5, Section 5.15 –

No garbage or trash shall be placed or kept on any Lot except in covered containers. Trash containers shall not be maintained/stored so as to be Visible from Neighboring Property except to make the same available for collection only for a reasonable time for such collection.

Rules & Regulations – Trash/Recycling Containers and Collection

No garbage or trash shall be placed or kept on any Lot, except in covered containers of a type, size and style which are approved by the ACC or provided by the City. Containers must be stored behind the fence or withing the garage during non-collection times, so as not to be Visible From Neighboring Property except on day(s) of collection.

Trash and debris are not to be placed/accumulate on any Lot. Garbage or trash placed on Lot Soley in connection any bulk trash pickup programs hall be acceptable so long as such garbage or trash is placed neatly on the Lot and is made available for collection no earlier than the weekend immediately prior to the weekday of collection.
